1. Acceptance of Terms
By accessing or using the Fundraiser Platform platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. If you do not agree to these Terms, you may not access or use the Service.
2. Definitions
The following terms have specific meanings when used in these Terms:
- "Organization" — A school, team, club, church, nonprofit, or other group that creates and manages fundraising campaigns
- "Company" — A business that lists products or services on the FindMyFundraiser Marketplace for organizations to use in their campaigns
- "Participant" — An individual who helps an organization by reaching out to personal contacts to support a campaign
- "Supporter" — An individual who donates to or makes a purchase through a campaign
- "Campaign" — A fundraising effort created by an organization, optionally featuring products from a Company
3. Age Requirements and Minors
- Users must be at least 13 years old to use the Service
- Users between 13 and 18 may use the Service only as campaign Participants, under the supervision of an adult-managed Organization
- The sponsoring Organization is responsible for ensuring appropriate parental or guardian consent is obtained for minor Participants
- Users who create Organization accounts, Company accounts, or manage campaigns must be at least 18 years old
- By creating an account, you represent that you meet these age requirements
4. Description of Service
Fundraiser Platform is a software-as-a-service (SaaS) platform that enables organizations to create, manage, and run fundraising campaigns. The Service includes tools for campaign creation, participant management, supporter outreach via SMS and email, payment processing, reporting, and fund disbursement. We may update, modify, or discontinue features of the Service at any time with reasonable notice.
5. Account Registration
To use the Service, you must register for an account and provide accurate, complete, and current information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized use of your account
- Keeping your account information up to date
We reserve the right to suspend or terminate accounts that contain inaccurate information or violate these Terms.
6. Communications and SMS Consent
- By using the Service, you consent to receive transactional communications (account notifications, campaign updates, password resets) via email and SMS
- Campaign Participants may receive automated SMS messages related to their campaign activity
- Contacts added by Participants may receive campaign-related SMS messages; the first message will identify who shared their number and include opt-out instructions
- You may opt out of SMS messages at any time by replying STOP or visiting findmyfundraiser.com/sms-optout

- Consent to receive communications is not a condition of using the Service
7. Donations and Purchases
- Donations and purchases made through the platform support the Organization's fundraising goals
- Refund requests for donations must be made within 30 days by contacting support@findmyfundraiser.com
- The Organization receiving the donation is responsible for fulfilling any associated products or services
- FindMyFundraiser is not responsible for the delivery of products or services offered by Organizations or Companies through the platform
- In the event of a fraudulent campaign, FindMyFundraiser reserves the right to suspend the campaign and process refunds at its discretion
8. Billing and Payment Terms
8.1 Subscription Plans
The Service is offered through subscription plans billed on a monthly basis. Your subscription automatically renews each month unless cancelled before the next billing date.
8.2 Usage-Based Fees
In addition to your subscription fee, certain usage-based charges may apply, including per-text messaging fees and per-signup fees. These usage fees are calculated and billed monthly in arrears based on your actual usage during the preceding billing period.
8.3 Platform Fees
Platform fees are deducted from donations at the time of payment processing. The applicable platform fee percentage is determined by your subscription plan and is clearly disclosed before any transaction is processed.
8.4 Payment Methods
A valid credit card or ACH bank account is required for payment of subscription and usage fees. You authorize us to charge your payment method for all fees incurred under your account.
8.5 Free Trial
New accounts are eligible for a 14-day free trial. At the end of the trial period, your account will automatically convert to a paid subscription and your payment method will be charged unless you cancel before the trial ends.
8.6 Pricing Changes
We reserve the right to adjust pricing at any time. We will provide at least 30 days' written notice before any pricing changes take effect. Continued use of the Service after a pricing change constitutes acceptance of the new pricing.
8.7 Refund Policy
Subscription fees are non-refundable. Usage-based fees are non-refundable once incurred, as they reflect services already rendered (messages sent, signups processed, etc.).
9. Storage and Usage Limits
Each subscription plan includes specific allocations for data storage, API access, and messaging volume:
- Storage allocations vary by plan and include campaign data, media uploads, and contact records
- API rate limits apply based on your subscription tier
- Exceeding your plan's limits may result in reduced service performance or overage charges at published rates
- A fair use policy applies to email volume; excessive or abusive email sending may result in account restrictions
We will make reasonable efforts to notify you before any overage charges are applied or service is reduced.
10. Supporter Fee Coverage
The Service offers supporters the option to cover payment processing fees at the time of donation. When a supporter elects to cover fees:
- The fee amount is calculated based on current processing rates and added to the supporter's total
- Due to rounding in fee calculations, the final charged amount may vary from the displayed estimate by a few cents
- The platform does not guarantee that the exact dollar amount of a donation will match the displayed estimate after all fees and rounding are applied
Organizations should not rely on fee coverage to produce a precise net donation amount.
11. Company Responsibilities
Organizations using the Service agree to:
- Provide accurate and truthful information in all campaign materials and descriptions
- Comply with all applicable local, state, and federal laws governing fundraising activities
- Use donated funds for the purposes described in their campaigns
- Maintain proper records and provide transparency to supporters regarding how funds are used
- Respond promptly to supporter inquiries and refund requests
- Obtain all required permits, licenses, or registrations for charitable solicitation in applicable jurisdictions
12. Prohibited Uses
You may not use the Service to:
- Conduct fraudulent fundraising or misrepresent the purpose of any campaign
- Engage in any illegal activity, including money laundering or financing of prohibited activities
- Send unsolicited bulk messages (spam) or violate anti-spam laws such as the TCPA or CAN-SPAM Act
- Create misleading campaigns that deceive supporters about the nature or recipient of funds
- Impersonate another person or organization
- Interfere with or disrupt the Service, its servers, or connected networks
- Attempt to gain unauthorized access to any part of the Service
- Use the Service for any purpose that violates applicable law or regulation
Violation of these prohibitions may result in immediate account termination and referral to appropriate authorities.
13. Intellectual Property
Platform Ownership: The Service, including its software, design, features, documentation, and all related intellectual property, is owned by Fundraiser Platform and its licensors. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without prior written consent.
Your Content: You retain ownership of all content you upload or create through the Service, including campaign descriptions, images, contact lists, and other materials. By using the Service, you grant us a limited license to host, display, and transmit your content solely for the purpose of providing the Service to you.
14. Payouts and Fund Disbursement
14.1 Payout Schedule
Payouts of collected funds are processed monthly via ACH direct deposit to the bank account on file for your organization. Payout timing may vary depending on verification status and banking processing times.
14.2 Fund Holds
We reserve the right to hold, delay, or withhold payouts pending identity verification, fraud investigation, or resolution of disputes. We will notify you if a hold is placed on your funds and work to resolve the matter as quickly as possible.
14.3 Tax Responsibility
Your organization is solely responsible for tax reporting on all funds received through the Service. We may provide tax documentation such as 1099 forms where required by law, but it is your responsibility to ensure compliance with all applicable tax obligations.
15. Termination
Either party may terminate this agreement at any time:
- By you: You may cancel your account at any time through your account settings or by contacting support. Cancellation takes effect at the end of your current billing period.
- By us: We may suspend or terminate your account immediately if you violate these Terms, or with 30 days' notice for any other reason.
Upon termination, your data will be retained for 30 days to allow you to export your information. After that period, your data will be permanently deleted. Any outstanding payouts will be processed according to the normal payout schedule, less any amounts owed to us.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUNDRAISER PLATFORM AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
Our total aggregate liability for any claims arising from or related to the Service shall not exceed the total amount you paid to us in the twelve (12) months preceding the claim.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
17. Changes to Terms
We may update these Terms from time to time. For material changes, we will provide at least 30 days' notice via email or a prominent notice within the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree with the changes, you must stop using the Service and cancel your account before the changes take effect.
18. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of law provisions.
19. Dispute Resolution
Any dispute arising from these Terms or your use of the Service shall first be resolved through good-faith negotiation. If unresolved within 30 days, the dispute shall be submitted to binding arbitration in Kansas City, Missouri, under the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action.
20. Indemnification
You agree to indemnify, defend, and hold harmless FindMyFundraiser.com, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your infringement of any rights of another party.
21. Force Majeure
FindMyFundraiser.com shall not be liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, labor disputes, power failures, internet disruptions, or government actions.
22. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
23. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
24. Waiver
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
25. Entire Agreement
These Terms, together with the Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and FindMyFundraiser.com regarding your use of the Service.
